Sony is facing a lawsuit in the UK that claims the PlayStation Store violates UK and EU competition law, and if the company loses, it could be facing a rather monumental fine. The lawsuit revolves around Sony’s control of content distribution and content prices. If you have a PS4 or a PS5, you buy digital content through the PlayStation Store. This is where all digital games and other content for the console can be found.
As a developer, Sony requires signing an agreement that says no digital content can be distributed outside of the PlayStation Store, and Sony has sole discretion on prices. Developers also have to agree to a 30% fee for distribution with each unit sale. In other words, Sony takes a 30% cut of each game sold. If this whole issue sounds familiar, that’s because it is. Google went through a very similar situation with Epic Games. A lawsuit very similar to this one was brought against it, though a fair amount of the particulars are unique. In Sony’s case, the lawsuit alleges that the PlayStation Store and its sole discretion on prices is a monopoly.
The lawsuit also alleges that Sony’s “monopoly” has led to higher game prices for consumers. As the case has just begun this week, it’s much too early to tell if things will go in Sony’s favor. However, Sony faces hefty fines if the class-action lawsuit ends up in favor of the consumer.
The PlayStation Store UK lawsuit could lead to $2.7 billion in fines
Should Sony lose this case, it could face up to $2.7 billion in fines. This could also lead to money back for UK consumers. According to the lawsuit, this would amount to around £100-£162 per consumer. The eligibility would require each consumer made one more “relevant purchases” on the PlayStation Store between August 19 2016, and February 12 2026.
The case is being led by Alex Neill, who states that gamers have been paying too much for games and deserve some of their money back. No doubt many gamers would not argue with that statement. For Sony’s part, the company says that it has invested billions in its platform. Additionally, it argues that its content strategy, fees included, isn’t excessive and that it reflects the market standard.
